House showdown: Court case draws national attention

Since March 2005, when Gainesville ordered the Building Systems Network chief executive officer to remove a partially-finished modular house in Waters Edge subdivision, Smereczynsky has sued in Hall County and federal court, rallied interest from the modular construction industry nationwide, and regularly pleaded his case to area media.

"I've chosen to continue the fight," Smereczynsky said last week. "... I'm in the deal to the end."

The deal has reached a new boiling point.

The city, feeding off a state Court of Appeals denial of Building System's appeal, on Sept. 12 gave the Gainesville company 30 days to remove the home on Waters Edge Drive. Smereczynsky is seeking a court stay.

An attorney representing the city's insurance company has also filed to dismiss constitutional claims in Smereczynsky's second lawsuit.

Local fireman's bravery earns state and local recognition

Volunteer fireman Mike Shrout risks his life to help others because that's what he does, not for the glory that follows.

During an open house held during Fire Safety Week in Fulton, Shrout was presented with the State Fire Marshals Lifesaving Award and an Award of Valor - two of the highest recognitions a fireman can receive.Shrout doesn't believe his actions deserve special honor. Following the presentation, the 25-year fire veteran said, “The award means a lot to me, but I don't feel I did anything that any other firefighter would not have done. That's what we do."Shrout was recommended for the awards for the “selfless action" he took this March in saving the life of a Fulton woman, who was trapped in the basement of her collapsed, tornado-ravaged home.According to Central Fire District Protection reports, the newly built modular home was lifted off its foundation and had caved in and split in two with homeowner Joyce King trapped under the debris. Her husband Lawrence - who had escaped and crawled to a neighbor's house for help - also was injured.

Police investigating mobile home fire as a murder

A deadly mobile home fire over the weekend has turned into a murder investigation. One man died, a woman is in critical condition, and police believe someone set the fire intentionally.

Flames broke out early Sunday morning at the Tropicana Village mobile home park. The survivor is barely hanging on right now, according to police. The woman, thought to be in her early twenties, has burns and took in quite a bit of smoke.

The man in the mobile home with her died in the fire and police believe someone had it in for the two of them.

The couple was sleeping in the front bedroom as the mobile home filled with smoke. Fire investigators say they don't have an exact cause yet, but Metro Homicide detectives have already zeroed in on the man they think set the place on fire.
